PIP declined as can drive

My husband is ok physically but suffers cognitive issues since his event, including social, reading and retaining information, sensory overload, and not being able to manage money. Etc etc Apparently if you can read it doesn’t matter if you can’t retain it!! Laughable as is the whole process.

He had a face to face assessment which was good and backed up the issues

Yet PIP has been declined as he drives short distances. We did the mandatory reconsideration and then went to appeal- call today reiterated that as he drives short distances he can multi task and therefore capable cognitively.

So the next step will be a tribunal. (Probably years away now ! Any suggestions or guidance for when it happens. Interesting that the DWP contact who phoned, said that we are doing the right thing by going to appeal.

There’s so much information on the web, just need the right stuff.

Who should we get advice from etc .

PIP cannot be refused solely on ability to drive. Your letter of refusal should have given the reasons.

You can get help with your appeal from CAB, Stroke Association and local Disability Rights organisations.

@Simont Hi I have never heard of it being assesed on driving ability? I find it bizarre like @Janetb has said citizens advice are very good but I had to appeal several times. In the end I got a welfare rights worker from the local council office, she spent hour or so on the phone with myself like an interview then she herself sent off the appeals procedure. I waited months to hear anything back but she got the appeal over turned and I was awarded it. Good luck on your appeal tribunal but please try seek some support as it’s a very frustrating process!

Honestly. It was literally that.

@Simont Take one task at a time and he will achieve more. the fact that he can drive short distances is amazing. He should be so proud of himself. Stroke recovery is ongoing forever. I speak as a stroke survivor myself. I wish you and your husband well for the future, be patient, take it real slow and you will soon be writing on here about all his progress. It does make a mockery of the system as they offer you a motability car if you get enhanced mobility on PIP.
